Trust Planning for Families and Individuals with Disabilities
Every family’s needs are unique. The Arc of Bristol County offers personalized estate planning to protect your loved one’s future. We help preserve assets, maintain eligibility for benefits, and plan for long-term care through tools like special needs trusts, wills, health care proxies, guardianships, and more.
While many rely on wills or powers of attorney, trusts can offer families and individuals with disabilities more flexible, affordable options. A trust lets a Trustee, like The Arc of Bristol County, manage assets for a loved one’s benefit—without needing to declare them incompetent—helping ensure long-term care, independence, and peace of mind.
Which plan should I choose?
Master Pooled Trust
(d)(4)(C) Trusts; self-settled
When funded by the assets of a person with a disability - such as from an injury settlement or house sale- funds are combined with those of others, yet individual investment growth is monitored. Each trust Beneficiary has a separate sub-account, while the funds are pooled for investment.
Master Family Pooled Trust
(d)(4)(A) Trust; funded by a third party
Funded with assets of a third party like a parent or grandparent for a person with a disability (ie will, savings, insurance policy). Funds are pooled with others for investment purposes, but growth is tracked individually. Because these accounts are not funded with the assets of the person with a disability, they do not include a MassHealth/Medicaid payback provision.
Successor Trustee Services
Self-settled or funded by third party
The Arc of Bristol County will take over currently as trustee or plan to take over in the future when needed.
